Why Mediate a Workers Compensation Claim

Traditionally workers compensation disputes have been handled by litigation through the State’s administrative adjudication system.  Since its inception in 1915 this system has required formalized procedures for public hearings and more recently has required a detailed explanation of the State’s decision.  These evidentiary and decisional requirements demand the presentation of voluminous evidence, including medical testimony.  A judge must hold hearings and issue a written decision disposing of all issues raised by the evidence presented. 

To fully adjudicate a petition a judge may hold several hearings over a period of months, often years,.  The decision is subject to appeal.  The Appeal process may take several more years.  Many claims must go through this process several times before concluded.  Some claims cannot be concluded through the traditional litigation process.  This process has associated costs in time and money.

While some cases may require such formal adjudication, not all cases require such treatment to reach a resolution in the best interests of the parties. Many cases may be more economically resolved by mediation.

Mediation is a more informal dispute resolution process that does not require such costly trappings as traditional litigation.  Although the State now requires mandatory mediation before a Judge, Private Mediation is an entirely voluntary.  No one will impose a result do not want on you.  The parties are free to schedule the mediation at their convenience, even before any petition is filed with the State.  The parties are free to negotiate their own resolution to the claim or dispute.  In a mediation session the parties privately negotiate to reach mutual agreement.  The Mediator makes sure neither side takes unfair advantage of the other and assists the parties as they negotiate a fair and fast resolution.
