When is the best time to mediate?
Mediation can occur at any time during the life of a claim but the best time to mediate is as soon as you have enough information to determine the extent of the injury. In cases where an injury has been recognized the best time to mediate would be before the filing of a petition to terminate, suspend or modify benefits.
How long does it take to mediate?
Typically a mediation session lasts from one to two hours, however with private mediation we can take the time that needs to be taken to resolve the case. Mediations can normally be scheduled within two to four weeks.
What is the cost of private mediation?
Mediation sessions on individual cases conducted at the Hall Law & Mediation Center in Dunmore, PA cost $500.00 for up to two hours with additional time billed at the hourly rate of $250.00. Sessions rarely last longer than two hours per case. Mediation sessions at other locations have similar pricing with allowance for travel time at a lower rate. Multiple sessions of up to eight cases per day at other locations is available at a daily rate with a similar allowance for travel.
Who should attend the mediation?
All decision makers should attend. At a minimum, the claimant, claimant's attorney and the attorney for the employer/insurer should attend with the adjuster or other representative of the employer/insurer available by telephone. Experience has shown however that the case has a better chance of settling if the adjuster or employer attends the mediation in person.
